By accessing or using the Site or platform, you confirm that you have read, understood, and agree to the Terms and related policies. If you do not agree, refrain from using the Site. Platform Availability

We do not guarantee the authenticity, accuracy, or completeness of the Content on our Platform, including that provided by other Users or Suppliers. All information, such as ratings (excluding star ratings for Accommodations), rankings, and reviews, is sourced from Suppliers or customer feedback. Additionally, we cannot ensure that the Content on our Platform remains unaltered due to technical issues or unauthorized interference by third parties.

You access all Content on our Platform at your own risk and bear full responsibility for any resulting harm or loss. com-stay.com is not liable for any loss or damage arising from the use or exposure to any Content on our Platform, including errors, omissions, or any changes we make. We do not guarantee uninterrupted availability of our Platform, and we are not responsible for any losses or damages caused by outages or service disruptions.

Our Platform does not offer any recommendation or endorsement of Products or Suppliers listed. We expressly disclaim any warranties regarding the quality, suitability, or reliability of any Products or Travel Suppliers featured on our Platform.

Users Content and Reviews

If you post or share content on our Platform, including reviews, you agree that:

1. You are solely responsible for the User Content you upload, and you affirm that it will not be false, misleading, discriminatory, or infringe on the rights of any third party, including privacy, intellectual property, or proprietary rights.

2. All User Content you provide is non-confidential, non-proprietary, and adheres to our review guidelines, including the Guest Review Guidelines.

3. Personal information should not be included in your User Content. If included, it will only be used in compliance with relevant data protection laws and our Privacy Policy.

4. While you retain ownership of the intellectual property in your User Content, by uploading it, you grant us and our affiliates a worldwide, royalty-free, non-exclusive, perpetual, and transferable right to use, reproduce, modify, display, and distribute your content for purposes such as marketing and advertising the Platform. You also waive any moral rights, where legally possible, in relation to the content.

5. You grant us permission to act on your behalf in addressing violations of rights related to your User Content.

6. Posting User Content does not imply our endorsement or affiliation with you.

7. We are not obligated to store or make your User Content available, and it is your responsibility to back up any important content.

8. We reserve the right to remove User Content at our discretion if it violates these terms, any applicable law, or poses harm. In such cases, we will inform you unless doing so would violate legal obligations, compromise investigations, or cause harm to other users, third parties, or our Platform.

Intellectual Property Rights

1. All content, technology, and trademarks on our Platform are owned by com-stay.com or its licensors. By using the Platform, you agree to use it only as intended and in compliance with our terms.

2. You may not copy, scrape, download, or use any part of the Platform for commercial purposes without written permission.

3. We monitor Platform activity and will block suspicious users or systems.

4. By uploading content, you confirm it complies with our guidelines, and you grant us permission to use it for commercial purposes. You assume full responsibility for any legal claims related to your content.

We may remove any content that doesn't meet our standards. We are not liable for user-uploaded content

5. Similarly, unless otherwise noted, all rights to the intellectual property, technology, trademarks, and content infrastructure of our Platform are owned by or licensed to com-stay.com. You agree to respect all copyright and trademark notices and will not obtain any rights beyond the limited license to use our Platform as outlined in these Terms. Any use of com-stay.com trademarks or service marks without prior written permission is prohibited. Nothing in these Terms grants you the right to use com-stay.com trademarks by implication or otherwise.

Limitation of Liability

These Terms do not limit our (or the Service Provider’s) liability for:
1. Negligence resulting in death or personal injury.
2. Fraud.
3. Gross negligence.
4. Any liability that cannot be legally limited.

If you breach these Terms or the Service Provider’s terms, we are not liable for any resulting costs.

Disclaimers of Liability

· Losses or damages that were not foreseeable when you made your or agreed to these Terms.
· Events beyond our control.
· We make no guarantees about Service Providers’ products and services beyond what is stated in these Terms.
· Our liability (or that of any Service Provider) is limited to reasonably foreseeable losses related to your Booking.
· These Terms are solely between you and us. No third party, except the Service Provider, has any rights under them.
· Mandatory consumer protection laws may provide you with rights that cannot be overridden by these Terms.

Events Beyond Our Control

We shall not be held liable for any breach of these Terms resulting from events or circumstances that are beyond our control or that of the Covered Parties. This includes, but is not limited to, natural disasters, adverse weather conditions, fires, nuclear incidents, electromagnetic pulses, acts of terrorism, riots, wars, arson, insurgencies, rebellions, armed conflicts, labor disputes, lockouts, strikes, shortages, governmental actions or restrictions, theft, bankruptcy, equipment malfunctions, disruptions in network or system operations, internet or communication failures, quarantines, epidemics, or pandemics.

Prohibited Actions

To ensure a safe and respectful atmosphere, users are explicitly forbidden from engaging in any actions that violate applicable laws or infringe upon the rights of others. The following activities are strictly prohibited:

Users must refrain from posting or disseminating defamatory, obscene, or illegal content. This includes hate speech, threats, and any material deemed harmful or offensive.

This includes sharing prohibited content or attempting unauthorized access. Upon termination, users must cease all activities on the platform and remove any associated information or content. Additionally, violations may be reported to the appropriate authorities, and the platform reserves the right to pursue legal remedies if necessary.
